Norwegian Housing Construction Act/bustadoppføringslova - information in English

In Norway, new residential buildings are subject to a statutory defect liability period of five years, as regulated by the Norwegian Housing Construction Act ("Bustadoppføringslova"). This means that buyers have the legal right to report construction defects or deficiencies for up to five years after the date of handover.

Please note that this is not a warranty in the traditional sense, but a legal right to claim for defects under Norwegian law.

To maintain this right, any defects which should have been discovered at the handover must be reported as soon as possible and without undue delay.


For other (hidden) defects, defects must be reported within a reasonable time after it is discovered or should have been discovered. What constitutes a reasonable time depends on the nature of the defect and the circumstances. If a defect is reported significantly later than when it was or should have been noticed, the claim will be considered invalid—even if the five-year period has not yet expired.
